I’ve been arrested: What are my arrest rights?
You have the right to remain silent. The only information you must provide Police is:
- your name
- your address
- your phone number
- your date of birth.
YOU DO NOT HAVE TO GIVE YOUR PASSWORDS TO YOUR MOBILE PHONE OR COMPUTER.
To all other questions you should answer ‘no comment‘ and ask to speak with a Solicitor. Police must assist you to contact a Solicitor.
Answering any questions only assists Police in gathering evidence against you. It is best to say nothing other than what we’ve advised above.
DNA SAMPLE
You must also allow Police to obtain a DNA sample if requested. In addition in a traffic matter if asked who the driver of a motor vehicle was and you know, you must tell them.
